What is Wrong with the Philips CPAP Machines?

The Lakewood CPAP lawsuit stems from the initial recall of Philips CPAP machines due to complaints of irritation and breathing difficulties, among other things. As a machine designed to alleviate respiratory distress, such reports were a red flag for medical providers. Initial reports also included other unpleasant side effects such as nausea, headaches, and inflammation.

Further investigation revealed that the breakdown of foam lining in many of these machines was to blame. While designed to reduce noise and vibration, the foam deteriorated in hot and humid conditions. This degradation led to inhalation or ingestion of foam particles and chemicals, resulting in the reported symptoms. Additionally, the polyester-based polyurethane materials used in the foam are toxic and may lead to certain cancers with prolonged exposure.

Another issue contributing to the Lakewood CPAP lawsuit is related to the devices overheating. There have been hundreds of formal reports of this nature, with some machines even allegedly catching fire.

A final and very serious issue found with the recalled Philips CPAP machines was their ability to interfere with pacemakers and other devices. This is due to magnets located inside the mask that block or deflect electromagnetic signals emitted by the devices. This particular issue resulted in an FDA Class I recall. Class I is reserved for products that may lead to “serious adverse health effects or death.”

Philips Respironics Lakewood CPAP Lawsuit Update

In total, there have been 116,000 reports of injury and 561 deaths linked to Philips CPAP machines. The company denies any responsibility for the reported deaths but did agree to a In $479 million settlement to cover alleged economic damages caused by the breathing devices. This settlement occurred in September 2023. As of February 2024, litigation is ongoing regarding further settlements related to personal injury and non-economic damages.

Specifically, the lawsuits currently underway against Philips Respironics are due to claims that the company had existing knowledge of the harm their products could cause. Evidence does, indeed, suggest that Philips knew about the foam degradation at least ten years prior to issuing the recall.

There are approximately 760 cases currently in review that allege personal injury, including cancer, along with further claims of violations of state consumer protection statutes, unjust enrichment, and breach of warranty.
